Terms of Service

Please read these Terms of Service ("Terms") carefully before using the PixieCraft mobile application, website, or related services (collectively, "PixieCraft" or the "Service"). By creating an account, accessing, or using PixieCraft, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About PixieCraft

PixieCraft is a platform that combines:

  • A perler-bead pattern community where users can share, discover, and save patterns.
  • A pattern creation tool for designing original perler-bead artwork.
  • An e-commerce marketplace for purchasing perler-bead supplies, materials, and related products.

2. Eligibility and Accounts

  • You must be at least 13 years old to use PixieCraft. If you are under the age of majority in your jurisdiction, you must have permission from a parent or guardian.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information when creating your account and to keep it updated.
  • We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

3. User-Generated Content

3.1 Your Content

You retain ownership of any original patterns, images, comments, profile information, and other content you post on PixieCraft ("User Content"). By posting User Content, you grant PixieCraft a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, distribute, promote, and modify your User Content solely for the purpose of operating and improving the Service.

3.2 Representations

You represent and warrant that:

  • You own or have the necessary rights to post your User Content.
  • Your User Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party.
  • Your User Content complies with these Terms and all applicable laws.

3.3 Prohibited Content

You may not post content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Promotes hate speech, discrimination, violence, or self-harm.
  • Infringes any third party’s copyright, trademark, or other intellectual property rights.
  • Contains malware, spam, phishing, or unauthorized advertising.
  • Depicts sexually explicit material involving minors or any non-consensual content.

4. Community Conduct

You agree not to:

  • Harass, bully, impersonate, or stalk other users.
  • Manipulate rankings, points, likes, follows, or engagement through bots, fake accounts, or other artificial means.
  • Attempt to circumvent any security, rating, or access controls.
  • Use the Service for any unlawful purpose or in any manner that could damage, disable, or impair the Service.

Violations may result in content removal, account suspension, permanent bans, and referral to appropriate authorities.

5. Pattern Creation Tool

  • The pattern editor and related design tools are provided "as is" for your personal and commercial use, subject to these Terms.
  • You are responsible for ensuring that any pattern you create or publish does not infringe third-party rights.
  • PixieCraft may offer templates, palettes, or asset libraries. Your use of these assets is governed by the license terms displayed with each asset.

6. E-Commerce and Payments

6.1 Product Listings

PixieCraft sells perler-bead supplies, materials, and related products directly or through integrated partners. Product descriptions, prices, and availability are subject to change without notice.

6.2 Orders and Payments

  • By placing an order, you authorize us to charge the payment method you provide.
  • All prices are displayed in the applicable currency and exclude taxes, shipping, and duties unless otherwise stated.
  • We reserve the right to refuse or cancel orders for any reason, including pricing errors, suspected fraud, or stock unavailability.
  • Payments are processed by third-party payment processors. Their terms and privacy policies apply.

6.3 Shipping and Returns

  • Shipping times and costs are estimated and may vary based on location and carrier.
  • Return, refund, and exchange policies are described at the point of purchase or in our Help Center.
  • You are responsible for providing accurate shipping information. We are not responsible for delays or losses caused by inaccurate addresses.

6.4 Subscriptions and Digital Goods

  • PixieCraft may offer subscriptions, premium features, or digital goods.
  • Subscription fees are billed on a recurring basis unless cancelled in accordance with the cancellation instructions provided in the app or platform store.
  • Digital goods (e.g., premium patterns, templates, virtual currency) are generally non-refundable once accessed or used.

7. Pixie Points and Creator Program

  • PixieCraft may award virtual points ("Pixie Points") or other incentives for community participation, check-ins, referrals, or creator activity.
  • Pixie Points have no cash value unless explicitly converted through a creator payout program that is subject to separate eligibility requirements.
  • We reserve the right to adjust, suspend, or terminate any points or rewards program at any time.
  • Creator payouts are subject to verification, minimum thresholds, tax documentation, and administrative approval.

8. Intellectual Property

  • PixieCraft and its licensors own all rights, title, and interest in the Service, including software, designs, trademarks, logos, and content provided by PixieCraft (excluding User Content).
  • You may not copy, modify, distribute, sell, lease, or reverse-engineer any part of the Service without our prior written consent.
  • The name "PixieCraft," the PixieCraft logo, and related marks are trademarks of PixieCraft or its licensors.

9. Copyright and DMCA

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact us with the following information:

  • A physical or electronic signature of the copyright owner or authorized agent.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the infringing material and its location on the Service.
  • Your contact information.
  • A statement that you have a good-faith belief that the use is not authorized.
  • A statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Repeat infringers may have their accounts terminated.

10. Third-Party Services

PixieCraft may integrate with or link to third-party services (e.g., Shopify, social media platforms, analytics providers). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

11. Termination

  • You may stop using the Service and delete your account at any time through the app settings or by contacting us.
  • We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.
  • Upon termination, all licenses granted by you to PixieCraft will survive to the extent necessary for us to maintain backups, enforce our rights, or comply with legal obligations.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PIXIECRAFT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PIXIECRAFT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PIXIECRAFT IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

14. Indemnification

You agree to indemnify and hold harmless PixieCraft and its affiliates, officers, employees, agents, and licensors from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to your User Content, your use of the Service, or your violation of these Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which PixieCraft operates, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the courts located in that jurisdiction, and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last updated" date. Your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
